Fees for Trademarks, Service marks, Appellations of origin of goods.

Trademarks are registered by the Russian Federal service for intellectual property, patents and trademarks (Rospatent) (hereafter – “the Russian Trademark Office”) subject to requirements and procedure provided by the Civil Code of the Russian Federation and Rules of compilation, filing and pendency of trademark and service mark applications.

The following documents shall be provided to the Russian Trademark Office for trademark registration:

1. a trademark application. Please note only legal persons and physical persons carrying out entrepreneurial activity are entitled to file the application;

2. a document confirming payment of the state duty for filling of the trademark application. We pay such a duty acting as trademark attorneys;

3. a power of attorney authorizing a trademark attorney to act on behalf of an applicant.

The state duty for filing trademark application amounts 8.500 Russian rubles (roughly EUR 200) and 1.500 Russian rubles (roughly EUR 35) for each additional class of the Nice Classification.

Trademark attorney fee for one application is EUR 150.

After submitting the trademark application to the Russian Trademark Office it carries out an expertise of a trademark. On the results of the expertise the Russian Trademark Office makes a decision on trademark registration or on refusal to register.

The registration procedure (from the moment of submitting the application on the registration of a trademark to the Russian Trademark Office till obtaining Certificate on Trademark) may take between 6 and 16 months.

In the course of the registration procedure foreign legal persons shall be represented by a patent attorney of the Russian Federation.

The following documents, information and materials shall be provided for trademark registration:

1. a power of attorney authorizing a patent attorney to act on behalf of an applicant;

2. a trademark sketch (a print of a trademark);

3. a list of goods and services to be covered by a trademark (grouped according to the Nice Classification)

4. a name of an applicant (in accordance with the foundation documents of a company);

5. a legal address of an applicant ( in accordance with the foundation documents of a company);

6. telephone and fax numbers of an applicant.

Additional Services Pertinent to the Trademark Registration

The Russian Trademark Office renders the following services pertinent to trademark search:

1. search of registered symbols and symbols applied for registration that are identical and similar to a symbol (verbal mark) specified by an applicant for classes of Nice Classification specified by the applicant. The Russian Trademark Office issues a listing of verbal elements of trademarks with registration numbers of relevant documents;

2. search of trademarks and symbols registered and applied for registration that are identical and similar to a graphic symbol provided by an applicant for classes of Nice Classification specified by the applicant. The Russian Trademark Office issues a report containing reproduction of a mark, information on a right holder (applicant) and its location.
